Platinum Pursuits contract terms and conditions:

Background:

a) Platinum Pursuits PTY LTD is one of the companies in the Platinum Pursuits Group PTY LTD that provides a range of educational training and support, products, specializing in teaching clients how to trade a variety of financial instruments, including training for consumers to educate themselves as to trading in stocks, options, CFDs, futures, international foreign exchange and commodities (“the training package(s)”).

b) Platinum Pursuits PTY LTD also, on its own behalf or as agent for others, provides data feed services and the entitlement to use software in conjunction with those data feed services, which can assist in the trading of stocks, options, CFDs, futures, international foreign exchange and commodities (Spectrum Live PTY LTD, Daily Trading Report, ShareChart Charting Software).

c) I (the person named in the personal details on the booking form attached) have decided to purchase the nominated training package and (if applicable) other additional products which are marked on the booking form and on the terms as marked on the booking form and otherwise in accordance with these terms and conditions

1. Agreement

1.1 I agree to pay for the nominated training package and (if applicable) other additional products in the manner that is indicated on the booking form. I agree that if any payment is refused or dishonoured the balance of the price will become immediately due and owing and may be recovered as a liquidated debt. I further agree that in the event that any payment is refused or dishonoured then you may cease the provision of any further service to me and that you will not be liable for any loss that I suffer by reason of that cessation.

1.2 In the event that you agree to refund to me any part of your training package fee, then I will return to you your training package and any copies or other documents relating to it in good order and condition via courier or Secure Post where all contributing expenses are paid by me.

1.3 I acknowledge that all monthly subscription service charges are automatically charged/debited the same day each month, or until cancelled. Monthly charges will automatically renew each month. To cancel any monthly product, I acknowledge that I must deliver a written termination notice, (via fax or email, return receipt requested) at least seven (7) calendar days before the monthly charge is scheduled to be charged/debited. I acknowledge that there will be no partial or pro rata refunds.

1.4 I acknowledge that Platinum Pursuits retains the right to discontinue free member services, or to exclude particular clients from any of these services, without notice and at their complete discretion.

2. Reservations and acknowledgements

2.1 I have purchased this product for the sole purpose of self-education and for no other purpose.

2.2 I acknowledge that the nominated training package and the Daily Trading Report does not constitute a recommendation or an offer to buy or sell any particular financial product, and that the information provided is of general research and notice of specific indicators as shown in market analysis software programs.

2.3 I acknowledge that the purchase, sale, or advice regarding any stocks, options, CFDs, futures, international foreign exchange and commodities can only be made in conformity with applicable state and/or federal laws. I acknowledge that I have been advised to speak with a licensed financial advisor of my choice regarding the suitability of investing in any particular investment or engaging in any particular investment strategy.

2.4 I acknowledge that you are the proprietor of the intellectual property and copyright in and to the training package and that it may not be transferred, reproduced or disseminated in any form. I acknowledge that my failure to observe this requirement may cause you to suffer loss and damage which I may be responsible to pay, as well as an administration fee of $50.00.

2.5 I acknowledge that financial trading is not suitable for many members of the public, and that I have been requested to carefully consider whether this type of training is appropriate for me given that it involves the risk of substantial losses.

2.6 I acknowledge that the financial markets can be volatile and that past performance indicators are not necessarily indicators of present or future performance.

2.7 I acknowledge that I am required to attend all live events within two (2) years of purchasing a package that includes (a) live seminar(s), or otherwise forfeit the attendance eligibility.

2.8 I also acknowledge that restrictions apply for live event reschedules/postponements. I am entitled to reschedule once with at least 48 hours notice before the event. Less than 48 hours notice or no-shows at the event will be regarded as a forfeit of my live placement, and further attendances will be charged the re-sit attendance fee.

2.9 The seminar re-attendance fee is subject to change without notice.

3. Limited right of refund

3.1 I acknowledge that I also have, provided that it is exercised during the refund period indicated on the booking form, the period starting as per the date initial payment was processed, the entitlement to request a refund of any money that I have paid if I demonstrate that I am not satisfied (on reasonable grounds) with the training course or its contents. I acknowledge that you have discretion as to whether or not you are satisfied with the basis upon which I have requested a refund, and that you shall require me to:

a) Provide a written report as to the basis upon which I am not satisfied and I acknowledge that I must make a reasonable and genuine attempt to participate and to achieve the desired outcome of the training;

b) Demonstrate that the deficiency is not simply that I am not suited to this type of activity, but rather it must be a deficiency in the goods and services provided by you;

c) Return to you the original copies (and any other copies) of the training package in an ‘as new’ condition;

d) Have commenced participation in the training course from the date of this agreement.
